Section 38

The consignor who wishes to transport goods by rail shall submit the form prescribed by the Board to the concerned Station Master.
(2) The sender of the prospectus as per sub-section (1) shall fill it clearly and the Board shall not be liable for the consequences arising from failure to fill the prospectus clearly.
(3) According to sub-section (1), the head of the station shall immediately conduct an inquiry on the sender's behalf as to whether or not the goods mentioned in the prospectus are correct or not.
(4) If there is any doubt as to whether any goods are prohibited or not during the investigation according to sub-section (3), the head of the station shall send such goods to the relevant agency for testing and the sender shall bear the cost of such testing.
(5) If any goods are proved to be prohibited goods during the examination according to sub-section (4), the head of the station shall entrust the concerned person with the goods to the relevant authorities for action according to the prevailing law.
